Federal Judge Mandates Release of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was held in federal custody.
In her decision, the court noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The legal proceedings center on disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.
Conditions of Freedom
The court, who was overseeing his challenge to deportation in a federal court, determined that he must now comply with the conditions of his bond from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
This ruling marks a notable development in a complex immigration battle involving claims of mistaken imprisonment and contested gang associations.
